If you would lose the duel then it is no longer a choice to lose the duel. How could this be used as a focus effect?

Focus Effects resolve before the duel does, so you choose to lose with Spirited Dispute and then resolve the duel which you were losing anyway.

Correct, winning is still winning and you still lose the duel, it's just that you don't suffer the consequences of losing.
